Terms and Conditions for the Supply of Milc Content
These Terms of Service constitute a legal agreement between you and Milc; please read them carefully.
You must be at least 13 years of age to use the Milc Service. If you are between the age of 13 and 18 you represent that you have received permission from your parent/guardian to complete the registration process on our Site and to download content to your mobile device.
By completing the registration process on our Site or any successor website thereto; by downloading mobile content to a mobile device (each a "Download"), you (1) represent that you are at least 13 years of age and (i) are the account holder or (ii) have the permission of the account holder of a participating mobile communications carrier to sign-up for and use the Milc Service on behalf of the account holder; and (2) agree on behalf of the account holder and yourself to be bound by these terms and conditions of this Agreement. If you access the Service through another website, please review these terms and conditions on that website or other posted guidelines as they may apply to your use. Any questions or comments regarding, or problems with, this Site should be sent to the Site Administrator at support@milc.co.za.
In this Agreement, "you" and "your" refer to each customer (including the subscriber of a participating mobile communications carrier on whose behalf you are entering into this Agreement) and his or her agents, and "we", "us" and "our" refer collectively to Milc and milc.co.za. This Agreement explains our obligations to you, and your obligations to us in relation to the Milc Service.
Company reserves the right to modify these Terms, in whole or in part, at any time. Changes to these Terms will be effective when posted. Your use of the Site, your subscription to a new Subscription Plan and/or if you maintain your existing Subscription Plan shall evidence your acceptance of the changes to these Terms and shall constitute your agreement to be bound thereby.
The Contract Between Us
- Any contract for purchases made through the web site will be with Milc, registered in South Africa.
- Once payment has been received Milc will confirm that your order has been received by sending a SMS to you at the mobile number you provide in your registration form.
- Milc's acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
- Milc are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the content appearing on our web site. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered before the contract is made (see (b) above) we will contact you as soon as possible by email.
- The prices payable for goods are as set out in the web site are inclusive of VAT.
Payment
This is a subscription based service. Billing is done strictly by debit order only. This is a monthly subscription based service and can only be terminated through a written request by you the customer.
Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
Responsibility
Milc takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of content. Please note that Milc requires Flash version 10 or above.
Country of domicile
This website is governed by the laws of South Africa and Milc chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
Force Majeure
Milc shall have no liability to you for any failure to deliver content you have ordered or any delay in doing so or for any damage or defect to content delivered that is caused by any event or circumstance beyond its reasonable control.
Complaints
Milc operate a complaints handling procedure which is used to try to resolve disputes when they first arise. If you have a complaint, please contact the Customer Service department at the following email address: support@milc.co.za
Entire Agreement
These terms and conditions, together with the current Milc Web site prices, delivery details and Milc contact details, set out the whole of our agreement relating to the supply of the content to you by Milc. These terms and conditions cannot be varied except in writing signed by a Member of Milc. In particular nothing said by any sales person on behalf of Milc should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any content offered for sale by Milc. Milc shall have no liability for any such representation being untrue or misleading.
Interpretation
In these terms and conditions:
'Milc' means Milc CC.
'working day' means every day of a calendar year apart from weekends and statutory and public holidays;
'us' means Milc and you together; and
'you' and 'your' means the person ordering goods under these terms and conditions.
